FRIO RIVER CABANA PARK
WAIVER AND RELEASE OF LIABILITY
In consideration of entry and the recreational use of the grounds, cabanas, river banks, river, equipment and facilities at the FRIO RIVER CABANA PARK, LLC, (hereafter the “PARK”), I (We) do hereby for myself, my (our) heirs, executors and administrators, waive, release, and forever discharge the PARK, its’ employees, agents, members and officers, and their respective heirs, successors, and assigns, from any causes of action, claims, liabilities or demands of any nature whatsoever, including but not limited to a claim of negligence, for personal injury, bodily injury, property damage, death or accident of any kind, arising out of or in any way relating to my participation in recreational activities, and/or the use of the grounds, cabanas, river banks, river, equipment or facilities at the PARK, whether by the negligence of the PARK or otherwise. I further agree not to sue and agree to indemnify and hold harmless the PARK and its’ employees, agents, members, and officers and their respective heirs, successors, and assigns, from any and all causes of action, claims, demands, losses, at law or in equity, direct and consequential, including attorneys’ fees, of any nature whatsoever arising out of or in any way relating to my participation in activities or programs, and/ or use of equipment or facilities at the Park

I (We) acknowledge that my presence and activities at the PARK exposes me to inherently dangerous conditions, activities, risks and hazards, including but not limited to: (i) pits, loose rocks and uneven ground surfaces; (ii) poisonous snakes, insects and spiders; (iii) slippery river rocks and surfaces; (iv) erosion and general condition of the land creating rough walking conditions; (v) wild animals, fish and birds, that may be diseased and/or potentially dangerous; and(vi) canyons and deep waters.

I (We) understand that my presence at the PARK and the activities that are conducted at the PARK, including specifically those activities that I will participate in at the PARK, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, successors, and assigns, and next of kin, I waive all claims for damages, injuries and death sustained to me or my property that I may have against the PARK, its’ employees, agents, members and officers, lessees, and their respective heirs, successors, and assigns.

WARNING TEXAS LAW (CHAPTER 75, CIVIL PRACTICE AND REMEDIES CODE) LIMITS THE LIABILITY OF AN OWNER, LESSEE OR OCCUPANT FOR DAMAGES ARISING ON LAND USED FOR RECREATIONAL PURPOSES THAT THE OWNER, LESSEE OR OCCUPANT OWNS, OPERATES, OR MAINTAINS FOR THAT PURPOSE.
POSTED SIGN on the Premises states:
WARNING UNDER TEXAS LAW (CHAPTER 75A, CIVIL PRACTICE AND REMEDIES CODE), AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AN AGRITOURISM ACTIVITY.
AGREEMENT AND WARNING
I UNDERSTAND AND ACKNOWLEDGE THAT AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AGRITOURISM ACTIVITIES. I UNDERSTAND THAT I HAVE ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM AGRITOURISM ACTIVITIES.
AN AGRITOURISM ACTIVITY MEANS AN ACTIVITY ON AGRICULTURAL LAND FOR RECREATIONAL OR EDUCATIONAL PURPOSES OF PARTICIPANTS, WITHOUT REGARD TO COMPENSATION.

Each person, including minors by and through their legal guardian, must sign this Waiver and Release of Liability before entrance to the Frio River Cabana Park will be permitted.
If you are accompanied by minors whose legal guardian is not present, that minor’s legal guardian must sign a Waiver and Releases of Liability to be sent with the minor that includes the legal guardian’s signature, printed name, address, email address.
Any person or minor that has not submitted a signed Waiver and Release of Liability will not be granted approval to enter the Frio River Cabana Park and will not be considered a guest of the Frio River Cabana Park. Reservations can be forfeited.
